These Terms of Service ("Terms") govern your access to and use of the InkStak website and web application (collectively, the "Service") operated by InkStak ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
Note: This document has not yet been reviewed by a lawyer. It is provided as a draft framework. Before you accept payments or allow real users to sign up, please have qualified legal counsel review and approve these Terms, particularly the subscription, refund, content ownership, and limitation of liability sections.
You must be at least 13 years of age to create an account and use the Service. Users between the ages of 13 and 17 should have the consent of a parent or guardian. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
The Service is designed to be used by parents, guardians, and educators on behalf of children. If you discover a child under 13 has created an account, please notify us at support@inkstak.ai.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.
You may not create multiple accounts to circumvent plan limits or to obtain the Free tier benefits more than once per person. We reserve the right to terminate duplicate accounts.
You agree to provide accurate and current account information. We may use your email address to send you transactional messages (receipts, account notices, security alerts). You may opt out of non-essential communications from your account settings.
We offer a Free tier and a paid Creator subscription, billed monthly or annually. Subscription prices are displayed on our Pricing page and are in Canadian dollars (CAD) unless otherwise stated. Applicable taxes may be added at checkout.
Paid subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. By subscribing, you authorise us to charge your payment method on a recurring basis.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain full access until then. We do not provide pro-rated refunds for unused time in the current billing period.
We reserve the right to change subscription pricing. We will notify existing subscribers by email at least 30 days before a price change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the new price.
If a payment fails, we will attempt to charge your payment method again. If payment remains unsuccessful, your account may be downgraded to the Free tier. Your stories and characters are not deleted; upgrading again restores full access.
Token packs are one-time purchases that grant you a set number of story generation credits. One token generates one complete story (including illustrations). Tokens do not expire and are non-transferable between accounts.
Token packs are non-refundable once any tokens in the pack have been used. If you have not yet used any tokens from a pack and believe you purchased it in error, contact us within 7 days of purchase at support@inkstak.ai and we will review your request.
You agree not to use the Service to:
We reserve the right to terminate accounts that violate these rules without notice or refund.
You retain ownership of the content you input into the Service: character descriptions, story prompts, and other text you provide. By using the Service, you grant us a limited, worldwide, royalty-free licence to use your input solely to generate stories and illustrations for you, to store and display your content within your account, and (if you choose to share) to display it in the Community.
We do not use your story content or character data to train AI models without your explicit consent.
Story text and illustrations generated by the Service are provided to you for your personal, non-commercial use. Subject to Section 6.3 below, we assign to you any rights we may hold in AI-generated content we create on your behalf, to the extent permitted by applicable law.
You are responsible for reviewing generated content before sharing, printing, or publishing it. We make no representation that AI-generated content is original, non-infringing, or appropriate for any specific purpose.
The legal status of AI-generated works varies by jurisdiction. In some countries, AI-generated content may not be protected by copyright or may have restricted protections. We make no warranty about your ability to assert copyright over stories or illustrations produced by the Service. You assume all risk related to publishing, selling, or otherwise commercialising generated content.
If you submit feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback freely without compensation or attribution to you.
Creator subscribers may optionally share stories with the InkStak Community. By sharing a story:
You can unshare a story at any time from your library. Unsharing removes the story from public display but may not remove it from caches immediately.
InkStak uses large language models and AI image generation models to create stories and illustrations. AI-generated content may sometimes be inaccurate, inconsistent, or unexpected. We do not guarantee that generated stories or illustrations will be free of errors, will be appropriate for all audiences, or will accurately reflect your prompts in every case.
You are responsible for reviewing all content before sharing it with or reading it to children. Our moderation systems are designed to reduce harmful outputs but are not perfect.
The Creator plan includes an export feature designed to produce files compatible with Amazon's Kindle Direct Publishing (KDP) platform. Use of KDP is subject to Amazon's own terms of service and content guidelines, which are your responsibility to review and comply with. We are not affiliated with Amazon and make no guarantee that KDP-exported files will be accepted by Amazon or meet their current requirements.
You are solely responsible for the content you submit to any third-party publishing platform, including compliance with Amazon's content policies, intellectual property policies, and applicable laws.
You may close your account at any time from the account settings screen. On account closure, your stories and characters will be deleted within 30 days, subject to our data retention obligations described in the Privacy Policy.
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or if we are required to do so by law. Upon termination for cause, any unused subscription time or token balance will be forfeited without refund.
We may discontinue the Service at any time. If we discontinue the Service, we will provide at least 30 days' notice and offer a pro-rated refund on any unused prepaid subscription time.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that generated content will be accurate, complete, or appropriate for any purpose.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL InkStak, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 CAD.
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless InkStak and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) content you submit or share; (c) your violation of these Terms; or (d) your violation of any third-party rights.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be submitted to binding arbitration in Ontario, Canada, under the rules of the ADR Institute of Canada. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from a court of competent jurisdiction.
If you are located in the European Economic Area or the United Kingdom, you may also be entitled to bring a claim before your local courts or seek mediation through an alternative dispute resolution body in your jurisdiction.
We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect and will update the "Last updated" date at the top of this page. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service and may close your account before the effective date.
